Your Right to Have your Repairs Completed

Under the Housing (Scotland) Act 2001 Scottish Secure Tenants and Short Scottish Secure Tenants have a right to have small urgent repairs carried out by their landlord within a given timescale.  This is called the Right to Repair Scheme and it applies to all of our tenants.

The Scheme covers certain repairs up to the value of £350.00 and these repairs are known as qualifying repairs.  These are listed below, along with the relevant response times:

*It should be noted that in most circumstances when you suffer from a total loss of electric power, gas or water supply it will be the responsibility of the public utility company that provides these services (Scottish Power, Scottish Gas or Scottish Water) to reinstate your supply.  Unfortunately the Association has no control over the response time for these companies.

Repair Orders – Completion Due Date

When you receive your copy of a Repair Order it will give a ‘completion due’ date by which any qualifying repair must be carried out.  If the first contractor has not completed the repair by the due date you may contact the alternative contractor, whose details are also given, and arrange for him to carry out the repair.  The alternative contractor would then advise us that you have asked them to carry out the repair and we will confirm the details with the contractor and pay you £15.00 compensation for the inconvenience of having to rearrange the job.

The alternative contractor would then have the same length of time to carry out the repair as the original contractor.  If they do not complete the repair within the time limit set, you will be entitled to a further £3.00 compensation for each working day until the repair has been completed – up to a maximum of £100.00.

If the first, or alternative, contractor cannot gain access to your home to carry out an inspection or repair at any time you have agreed with the Association then your Right to Repair will be cancelled.  You then have to re-apply for the repair to be carried out and start the process again.  Please also not that in these circumstances you may be charged for the contractor’s time for attending the abortive call.
