The Right to Buy

The recent Housing (Scotland) Act 2010 introduced yet more changes to the regulations governing the Right to Buy and, as a result, the rules are now extremely complex and confusing.

Your right to buy and the level of discount you are entitled to is dictated by when the property you are living in was built and when you became a tenant.  A brief explanation of the current position is given below but if you are considering buying your home from the Association, we recommend that you contact the office directly to clarify your own situation and rights.

 

 
Update on The Right To Buy

Tenancies
That Began
Prior to 1989

 

If your tenancy with the Association started before 1989 and you still live in the same house you will have what is known as the PRESERVED RIGHT TO BUY entitlement.

This means that you can apply to buy your house at any time and will be eligible for discounts up to a maximum of 60 percent (Houses) and 70 percent (Flats).

Tenants That Transferred from
Scottish Homes

 

If you became a tenant of the Association following a transfer from Scottish Homes in 1996 and you still live in the same house you will also have the PRESERVED RIGHT TO BUY and can apply to buy your house at any time and be eligible for discounts up to a maximum of 60 percent (Houses) and 70 percent (Flats).

Properties Built Before
September 2002

 

If you live in a property that was built by the Association before 30th September 2002 you CURRENTLY DO NOT have the right to buy this property as these properties are currently subject to a 10-year exemption from the Right to Buy.

Although the exemption period is due to end on the 30th September 2012 the Association can apply to the Scottish Government for a further exemption on these houses beyond September 2012.  The Association's Board of Directors will shortly be considering if it wishes to submit an application for a further 10 year exemption.

Properties
Built After
September 2002

 

If you live in a property that was built by the Association after September 2002 you will have the MODERNISED right to buy your property.  This means that;

  • You must have been a tenant with any social landlord for at least 5 years before you can apply to buy your house.
  • The level of discount starts at 20 percent and increases by 1 percent for every additional year you have been a tenant up to a maximum of either 35 percent or £15000, whichever is the lower.

    However - If the house you live in is less than 10 years old OR has been substantially renovated within the last 10 years the selling price or the amount of discount is likely to be affected.

Tenancies That
Began After
1st March 2011

 

If your tenancy with the Association began after the 1st March 2011 AND you are either a first time tenant or you are returning to the social rented sector, you DO NOT HAVE THE RIGHT TO BUY under new rules introduced by the Scottish Government in the 2010 Housing Act.

Transferring
Tenancy

 

If you are considering moving to another house either with the Association or with another social landlord you should check how this will affect your current right to buy before moving.
